By using ShipKaro, you agree to these terms. Please read carefully. These terms constitute a legally binding agreement.

1. Acceptance of Terms

  • By registering or using ShipKaro, you agree to these Terms of Service and our Privacy Policy.
  • If you are using ShipKaro on behalf of a business, you represent that you have authority to bind that business.
  • We reserve the right to modify these terms with 30 days notice. Continued use constitutes acceptance.

2. Services

  • ShipKaro provides a technology platform connecting sellers with courier services for shipment booking, tracking, and management.
  • We are a technology intermediary, not a courier company. Actual delivery is performed by partner couriers.
  • Service availability is subject to courier partner serviceability in your area.
  • We reserve the right to refuse service to any user at our discretion.

3. Seller Obligations

  • You must provide accurate sender, receiver, and product information for all shipments.
  • You are responsible for proper packaging of shipments. ShipKaro is not liable for damage due to inadequate packaging.
  • You must not ship prohibited items including: weapons, narcotics, counterfeit goods, live animals, hazardous materials, or items prohibited by law.
  • You are responsible for GST compliance on your sales. ShipKaro provides GST invoices for shipping charges only.
  • COD amounts must accurately reflect the actual product price. Inflated COD amounts are prohibited.

4. Payments & Wallet

  • Wallet recharges are non-refundable except in cases of platform error.
  • Shipping charges are deducted at the time of shipment creation.
  • COD remittances are processed within 2-7 business days after delivery confirmation.
  • ShipKaro reserves the right to hold COD remittances in cases of suspected fraud or disputes.
  • Disputed charges must be raised within 30 days of the transaction.

5. Liability & Indemnification

  • ShipKaro's liability for lost or damaged shipments is limited to the declared value or Rs.5,000, whichever is lower.
  • We are not liable for delays caused by courier partners, natural disasters, strikes, or government actions.
  • You agree to indemnify ShipKaro against claims arising from your use of the platform, including prohibited shipments.
  • ShipKaro is not liable for indirect, consequential, or punitive damages.
  • Our total liability in any calendar month shall not exceed the shipping charges paid by you in that month.

6. Prohibited Activities

  • Attempting to reverse-engineer, hack, or disrupt the platform.
  • Creating multiple accounts to circumvent restrictions.
  • Using the platform for money laundering or financial fraud.
  • Submitting false shipment information or fraudulent COD orders.
  • Sharing API keys or account credentials with unauthorized parties.

7. Intellectual Property

  • ShipKaro, its logo, and platform are owned by ShipKaro Technologies Pvt. Ltd.
  • You retain ownership of your business data. You grant ShipKaro a license to process this data to provide services.
  • You may not use ShipKaro's branding without written permission.

8. Termination

  • Either party may terminate the account with 30 days written notice.
  • ShipKaro may immediately suspend accounts for fraud, prohibited shipments, or violation of these terms.
  • Upon termination, pending shipments will be completed. Wallet balance will be refunded within 30 days.
  • Data will be retained as required by law after account closure.

9. Dispute Resolution

  • Disputes should first be raised through our support system at support@shipkaro.com.
  • Unresolved disputes will be subject to arbitration under the Arbitration and Conciliation Act, 1996.
  • Arbitration will be conducted in Hyderabad, Telangana.
  • Courts in Hyderabad, Telangana have exclusive jurisdiction for any legal proceedings.

10. Governing Law

  • These terms are governed by the laws of India.
  • The Information Technology Act, 2000 and Consumer Protection Act, 2019 apply where relevant.
  • For enterprise clients, specific SLA agreements supersede these general terms where they conflict.
